This book introduces the reader to key legal provisions and case-law related to the procedural and substantive issues that may arise in damages litigation for breach of anti-competitive agreements and abuses of a dominant position prohibitions. For the past decade, academic publications have focused on the proposal for a Directive on damages actions, then the Directive 2014/104/EU of 26 November 2014 itself, and finally the transposition texts. However, this understandable interest should not lead to overlook the fact that the Directive has been applied very little until now. This is mainly due to its application ratione temporis. In addition to the fact that Member States only transposed the Directive between the end of 2016 and 2018, Article 22 of the Directive provides that the substantive rules contained in the Directive cannot be applied to infringements subsequent to the national laws transposing them, while the procedural rules of the Directive apply to proceedings commenced on or after 26 December 2014. Thus, it is prior domestic law that continues to govern the vast majority of cases before national courts in the “Pre-Directive era.” In addition, a number of issues of the utmost importance have not been addressed by the Directive, such as questions of international jurisdiction or the quantification of “interests.” For these reasons, it seemed necessary not to limit this book to commenting on the Directive, important as it is, but to go beyond it. Directed by Rafael Amaro, this book contains the contributions from leading academics, attorneys, jurists and economists in the field of the private enforcement of competition law. Laws by Plato The Laws (Greek: Νόμοι, Nómoi; Latin: De Legibus) is Plato's last and longest dialogue. The conversation depicted in the work's twelve books begins with the question of who is given the credit for establishing a civilization's laws. Its musings on the ethics of government and law have established it as a classic of political philosophy[citation needed] alongside Plato's more widely read Republic. Scholars generally agree that Plato wrote this dialogue as an older man, having failed in his effort to guide the rule of the tyrant Dionysius I of Syracuse, instead having been thrown in prison. These events are alluded to in the Seventh Letter. The text is noteworthy as Plato's only undisputed dialogue not to feature Socrates. Unlike most of Plato's dialogues, Socrates does not appear in the Laws: the dialogue takes place on the island of Crete, and Socrates appears outside of Athens in Plato's writings only twice, in the Phaedrus, where he is just outside the city's walls, and in the Republic, where he goes down to the seaport Piraeus five miles outside of Athens. The conversation is instead led by an Athenian Stranger (Greek: ξένος, romanized: xenos) and two other old men, the ordinary Spartan citizen Megillos and Cleinias of Crete, from Knossos. The Athenian Stranger, who resembles Socrates but whose name is never mentioned, joins the other two on their religious pilgrimage from Knossos to the cave of Zeus. The entire dialogue takes place during this journey, which mimics the action of Minos: said by the Cretans to have made their ancient laws, Minos walked this path every nine years in order to receive instruction from Zeus on lawgiving. It is also said to be the longest day of the year, allowing for the densely packed twelve chapters.

In twenty years, the globalization of trade has led to a change in scale that has upset the balance of power between the players in online containerized maritime transport and the logistics chain passing through European seaports. Three global shipping alliances dominate 90% of online containerized maritime transport, while further integrating port activities. Twelve Asian ports, eight of which are Chinese, are now among the top fifteen in the world. At the same time, Chinese interests, supported by public authorities and resources, are taking control of terminals and port companies in Europe, as part of the geopolitical project of the New Silk Roads. This economic and industrial context is emblematic of the challenges facing European competition law, which has so far accompanied rather than controlled these transformations. European competition rules will have to be mobilized in a global context, alongside the new rules on the control of foreign direct investment. This study takes stock of the new regulatory challenges in this sector of prime importance for the Union.

New Caledonia is a special collectivity of France, currently governed under the Nouméa Accord, located in the southwest Pacific Ocean, to the south of Vanuatu, about 1,210 km (750 mi) east of Australia and 20,000 km (12,000 mi) from Metropolitan France. The archipelago, part of the Melanesia subregion, includes the main island of Grande Terre, the Loyalty Islands, the Chesterfield Islands, the Belep archipelago, the Isle of Pines, and a few remote islets. The Chesterfield Islands are in the Coral Sea. French people, and especially locals, refer to Grande Terre as Le Caillou ("the pebble"). New Caledonia has a land area of 18,576 km (7,172 sq mi) divided into three provinces. The North and South Provinces are located on the New Caledonian mainland, while the Loyalty Islands Province is a series of islands off the mainland. Its population of 268,767 (August 2014 census) consists of a mix of the original inhabitants, Kanak people, who are the majority in the North Province and the Loyalty Islands Province and people of European descent (Caldoches and Metropolitan French), Polynesian people (mostly Wallisians), and Southeast Asian people, as well as a few people of Pied-Noir and North African descent who are the majority in the South Province. The capital of the territory is Nouméa. The earliest traces of human presence in New Caledonia date back to the Lapita period c. 1600 BC to c. 500 AD. The Lapita were highly skilled navigators and agriculturists with influence over a large area of the Pacific. On 24 September 1853, under orders from Emperor Napoleon III, Admiral Febvrier Despointes took formal possession of New Caledonia. Captain Louis-Marie-François Tardy de Montravel founded Port-de-France (Nouméa) on 25 June 1854. A few dozen free settlers settled on the west coast in the following years. New Caledonia became a penal colony in 1864, and from the 1860s until the end of the transportations in 1897, France sent about 22,000 criminals and political prisoners to New Caledonia. The Bulletin de la Société générale des prisons for 1888 indicates that 10,428 convicts, including 2,329 freed ones, were on the island as of 1 May 1888, by far the largest number of convicts detained in French overseas penitentiaries. The convicts included many Communards, arrested after the failed Paris Commune of 1871, including Henri de Rochefort and Louise Michel. Between 1873 and 1876, 4,200 political prisoners were "relegated" to New Caledonia. Only 40 of them settled in the colony; the rest returned to France after being granted amnesty in 1879 and 1880.

What happens when South Africa's tumultuous political life becomes entangled in the courts of law? Throughout the past 50 years, the courts have been a battleground for contesting political forces as more and more conflicts that were once fought in Parliament or in streets, or through strikes and media campaigns, find their way to the judiciary. Certainly, the legal system was used by both the apartheid state and its opponents. But it is in the post-apartheid era, and in particular under the rule of President Jacob Zuma, that we have witnessed a dramatic increase in 'lawfare': the migration of politics to the courts. The authors show through a series of case studies how just about every aspect of political life ends up in court: the arms deal, the demise of the Scorpions, the Cabinet reshuffle, the expulsion of the EFF from Parliament, the nuclear procurement process, the Cape Town mayor – the list goes on and on. It argues that while it is good that the judiciary is able to shoulder the burden of supporting democracy, it is showing signs of immense strain under the present deluge of political cases. The Sovereign debt crisis pushed the EU to take a new step to the common financial rules. After some years of ‘soft budgetary carefreeness’, the European Budgetary Treaty boosted the movement of budgetary convergence in the EU. The ‘Six Pack’ and the ‘Two Pack’ consolidated the effectiveness of a new European budgetary order founded by the Maastricht Treaty and the Stability and Growth Pact. Even if mechanisms adopted by the Member States are formally different in law, conditions of European budgetary orthodoxy have been definitively hardened. This new rigor has a great impact on all the public administrations, as defined by the European Accounts System and Eurostat. The EU is a key-player of the budgetary game. This great power makes the EU accountable to the general economic situation within Europe and amongst all Member States. Budgetary regulation must be conciliated with preservation of some investment means to develop potential growth on the continent. ‘Giant in law’, the EU has to be responsible from an economic point of view. The problem is that, from a budgetary standpoint, the EU remains a ‘dwarf’. The European general budget is about 1% of the EU gross national income. The budgetary power of the EU is less than one twentieth of the USA federal financial power. Balance between ‘budgetary dwarf ’ and ‘giant in law’ is characteristic of ‘adolescence’ of the EU finances. Natural consequence of this situation, the EU capacities for redistributing and stabilization are still relatively limited. To overtake this powerlessness, the EU has used no budgetary tools by appealing to the European Investment Bank and the European Investment Fund. However, the ability of the EU to support public investment is not sufficient today to promote an authentic economic relaunching policy and to support the global competition, especially with the USA and China. With a ‘powerful brake’ and a ‘poor accelerator’, the risk is the European public investments continue to stand by. This is the investment paradox of the European budgetary order. Will the next negotiation on the multiyear financial framework post 2020 be able to change the point ? It is not sure, especially in the Brexit context. Negotiating an European financial agenda is always long and difficult. But, the exit of the United Kingdom could makes the game more disputed than ever. A thing is clear : beyond the technical and financial sizes of the new roadmap proposals established by the Commission, the democratic control of the European Parliament is still limited. The EU budgetary framework and timetable are too inert, not enough reactive, far from European citizens actually. In the historical moments we live, it is certainly a strategic mistake to not involve much more citizens and their representatives in the crucial negotiation on the long-term finances of the EU. This is the technocratic risk of the new European budgetary order.
