IS THERE A CRIMINAL TYPE? After years of close observation, during which I have formed many friendships with criminals, I can only answer this question in the words that I have answered it before, and say that, physically, I have not found any evidence to show that a criminal type exists. In saying this I know that I shall run counter to the teaching of a good many people, and probably run counter to public opinion. For the criminal class and the criminal type have been written about so largely, and talked about so frequently, that the majority of people have come to the conclusion that our criminals come from a particular order of society, and that the poorest; or that there exists a type of people whose physical appearance gives outward and visible signs that proclaim the inward criminal mind. I believe both these ideas to be entirely wrong. I was confirmed in my opinion last year when I visited many of the largest prisons in the United States; for I found there, as I have found in England, a complete absence among the prisoners of those physical and facial peculiarities that we are taught to believe differentiate criminals from ordinary citizens. Speaking on this subject to the American Congress at Washington on October 4, 1910, Sir Evelyn Ruggles-Brise, K.C.B., the esteemed chairman of our Prison Commissioners, made the following statement— "There is no criminal type. Nothing in the past has so retarded progress as the conviction, deeply rooted and widespread, that the criminal is a class by himself, different from all others, with a tendency to crime, of which certain peculiarities of body are the outward and visible signs. "This superstition, for such I think it must be called, was, you know, strengthened and encouraged by the findings of the Italian school.

En un sentido similar, la literatura existente sobre la justiciabilidad y judicialización del derecho a la salud se ocupa de la cuestión de si los jueces deben intervenir o no en la protección del derecho a la salud. Objetivo: Evaluar los desafíos derivados del litigio del Derecho a la Salud en Colombia, Argentina, Brasil y México. Metodología: Marco analítico y metodológico cualitativo, descriptivo y comparativo. Incluye una revisión bibliográfica y 37 entrevistas semiestructuradas a jueces, académicos y funcionarios gubernamentales. Además, se realizó un análisis jurisprudencial de la jurisprudencia más reciente en los 4 países mediante análisis de contenido. Resultados: En los cuatro países estudiados persiste un enfoque moderado orientado a las repercusiones en el litigio y, preocupado por las consecuencias del proceso de judicialización. Esto supone, en primer lugar, la incorporación de algunos límites y condiciones en el reconocimiento del derecho a la salud por parte de los Tribunales y, en segundo lugar, en términos generales, que las sentencias no están teniendo en cuenta las causas estructurales que afectan a la litigiosidad. Conclusiones: Los tribunales deberían avanzar hacia un equilibrio intencional en el reconocimiento, los remedios, la supervisión y la evaluación de las sentencias. Esto implica ser más reflexivos y estratégicos que reactivos y pasivos. En otras palabras, cuanto más inmaduro sea el sistema sanitario y más causas estructurales se perciban, más reflexivos y estratégicos deberían ser los Tribunales y más se debería promover el reconocimiento, la protección, la supervisión y la evaluación. Los Estados también deben adoptar medidas contundentes contra las causas estructurales y deben hacer operativo un enfoque de la salud más práctico y basado en los derechos, de manera tangible.

However, this seemingly straightforward definition belies the intricate interplay of factors that contribute to the phenomenon. From structural shifts in industries to cyclical fluctuations in economic activity, the causes of unemployment are varied and nuanced. Why is it crucial to dissect the issue of unemployment? Beyond its economic implications, unemployment carries profound social, psychological, and political ramifications. High levels of unemployment can lead to social unrest, exacerbate inequality, and strain public resources. Moreover, the personal toll of unemployment on individuals and families cannot be overstated, as it often results in financial hardship, diminished well-being, and a sense of alienation.

Four years ago, I set out to write a book that memorialized the change from non-unanimous juries back to jury unanimity in Louisiana. The ending was going to celebrate the death of Jim Crow juries. Before the ink could dry on that project, there were signs of Jim Crow lurking still. This time, it was not non-unanimous juries. It was the jury of twelve that we sought, but it was not the jury box that we imagined. Now, the twelve jurors, more often than not, were all white. People of color still−even after the death of non-unanimous juries−were not experiencing the unique power that the jury box could grant them. Accused people still weren’t experiencing the full protections of the Sixth Amendment. To do justice to the topic of Jim Crow juries or jury suppression, the discussion must long predate non-unanimous juries. In fact, it can’t begin with juries at all. By necessity, the beginning has to be at the beginning−at the point law and race were joined to create diminished procedural safeguards for those of color, as well as different rights and different restrictions. To be credible, conversations about race and juries must always be anchored to this history. This book does that work and, in doing so, establishes the jury as a specific site of systemic racism both for the accused person of color and for the juror or prospective juror of color. After, it assesses the impact of years of systemic inequities within the legal system. The book illuminates a legal system that operates much like an assembly line. It moves fast, is solely interested in profits and production , is automated and impersonal. Specifically, this book seeks to: (1) aid the reader in viewing Louisiana’s unanimous jury campaign in its racial and historical context; (2) examine the historical connection between Black juror suppression and how it is bound up in the creation and perpetuation of race and supremacy; (3) situate the jury at the center of a carceral state polluted with bias, supremacy and racism, as well as an urge to respond punitively to the most basic of human transgressions; (4) help readers achieve a holistic and comprehensive view of Louisiana’s legal system and the competing factors and interests that have shaped it and led to it becoming harmful to most who come in contact with it; and, (5) to awaken a desire for transformation.
